These Terms & Conditions (the “Terms”) form a legally binding agreement between you and the owner/operator of lucianomarazzo.com, store.lucianomarazzo.com, lessons.lucianomarazzo.com, and portal.lucianomarazzo.com (collectively, the “Site”). References to “we,” “us,” or “our” mean Luciano Marazzo and any affiliated business entities that operate the Site and related services (collectively, the “Company”).
By accessing or using the Site, purchasing products, booking lessons, joining communities, or otherwise using any feature of our services (the “Services”), you agree to be bound by these Terms and our Privacy Notice and Cookie Notice (collectively, the “Policies”). If you do not agree, do not access or use the Services.
1) Scope & Subdomain Coverage
These Terms apply to all Services delivered through:
lucianomarazzo.com (main website and booking/EPK/communications)
store.lucianomarazzo.com (store, offers, physical/digital products, affiliate links)
lessons.lucianomarazzo.com (private lessons, coaching, courses, scheduling)
portal.lucianomarazzo.com (student/community portal, forums, gated resources)
The Services may integrate third‑party platforms (e.g., payment processors, video hosting, scheduling tools, learning platforms, community forums). Those platforms have their own terms and privacy practices which you must review separately.
2) Eligibility; Accounts; Accuracy of Information
Minimum Age. You must be at least 16 years old to use general Site features and at least 18 years old to make purchases, enroll in paid Services, or enter into contracts. Where parental consent is legally required, you represent that such consent has been obtained.
Account Security. You are responsible for all activity that occurs under your account and must maintain the confidentiality of your login credentials. Notify us immediately of unauthorized use.
Accurate Data. You agree to provide accurate, current, and complete information, and to update it as needed. We may suspend or terminate accounts for false information, abusive behavior, or violations of these Terms.
3) Orders, Pricing, Taxes & Availability
Offer & Acceptance. Listings on the Site are invitations to treat, not binding offers. We may accept or reject an order in our sole discretion. A contract is formed only when we send an order confirmation.
Pricing. Prices are shown exclusive of applicable taxes unless stated otherwise. We may correct pricing or typographical errors at any time and cancel orders affected by such errors.
Taxes & Duties. You are responsible for all applicable sales/use taxes, VAT/GST, customs duties, import fees, and similar charges. For cross‑border shipments, you are the importer of record.
Availability. Products and Services are subject to availability. We may limit quantities and discontinue items at any time.
4) Refunds, Returns, Cancellations & Chargebacks (Manual, Case‑by‑Case)
Our policy is to review refund and return requests manually and internally before any refund is executed. Submitting a request does not guarantee approval.
4.1 General Principles
Eligibility Window. Unless a specific product page states otherwise, you must submit refund/return requests within 14 days of purchase or delivery (for digital goods, within 14 days of purchase). For lessons or bookings, see Section 8.
Proof & Cooperation. You must provide order details, receipt, and any requested documentation or screenshots. For digital products/courses, we may require proof of good‑faith effort (e.g., lesson logs, exercise completion) to evaluate the request.
Condition & Access. For physical goods, items must be unused, in original packaging, and returned with an RMA number (when applicable). For digital goods, your license may be revoked on approval of a refund.
Non‑Refundable Items. Unless required by law or expressly stated on a product page: (i) digital downloads, course enrollments, memberships, and time‑based access are non‑refundable once accessed or materially used; (ii) custom services (arrangements, private consulting, performance bookings) are non‑refundable after work begins.
Return Shipping. Return shipping and risk of loss are your responsibility unless we specify otherwise in writing.
4.2 Evaluations & Outcomes
Internal Review. We evaluate each request to confirm eligibility, use/misuse, compliance with these Terms, and fraud screening. We may approve a full or partial refund, decline the request, or propose a store credit.
Form of Refund. When approved, refunds are issued to the original payment method where possible. Processing times depend on your bank or payment provider.
Chargebacks. Filing a chargeback before giving us the opportunity to resolve an issue may be considered a breach of these Terms. We reserve the right to dispute chargebacks and to suspend or terminate access for fraudulent or abusive chargeback behavior.
4.3 Cancellations (Digital Subscriptions/Memberships)
You may cancel future renewals at any time from your account or by contacting us. Cancellations stop future charges; they do not retroactively refund past periods unless required by law or expressly stated otherwise.
5) Bookings, Lessons, Coaching & Scheduling (lessons.lucianomarazzo.com)
Scheduling. Lesson times are confirmed only after our written confirmation. We may reschedule for teacher availability, illness, force majeure, or technical issues.
Student Preparedness. You are responsible for having a functional instrument/voice health, internet, camera/mic, and any required software/materials.
Cancellations by Student. Unless specified otherwise on the booking page or invoice, 48 hours’ notice is required to reschedule without penalty. Late cancellations/no‑shows may be charged the full lesson fee.
Cancellations by Instructor. If we cancel, we will offer a reschedule or credit.
No Medical Advice. Voice and instrumental guidance is educational only and not medical advice. See Section 13.
6) Live Events, Performances & Venue Terms
Deposits. Performance bookings may require non‑refundable deposits to secure dates.
Venue Rules. You agree to comply with venue policies (sound levels, safety, insurance, minors, etc.).
Force Majeure. See Section 17 for delays or cancellations outside either party’s control.
7) Digital Products, Licenses & Access Controls
License Grant. Upon full payment, we grant you a personal, limited, revocable, non‑exclusive, non‑transferable license to access and use purchased digital content for your private, non‑commercial use, unless a product page expressly grants additional rights.
Prohibited Uses. You may not copy, share, sell, resell, sublicense, publish, upload, or distribute our content or circumvent access controls. Classroom, studio, or commercial use requires a written license.
Access Windows. Gated content and communities may have time‑limited access. We may archive or retire materials; reasonable substitutes may be offered.
8) Community & Portal Rules (portal.lucianomarazzo.com)
Respectful Conduct. No harassment, hate, spam, unauthorized promotions, or illegal content. We may moderate, remove content, or suspend accounts at our discretion.
Your Content. You retain ownership of content you post, but grant us a non‑exclusive, worldwide, royalty‑free license to host, display, and use it to operate the community and promote the Services (with reasonable attribution).
Feedback. You grant us the right to use feedback/suggestions without restriction or compensation.
9) Intellectual Property & DMCA
Our IP. The Site, designs, recordings, scores/arrangements, videos, graphics, trademarks, and all other content are protected by intellectual property laws. All rights not expressly granted are reserved.
DMCA Notices. If you believe your copyrighted work was used on the Site without authorization, send a notice to our designated agent with: (i) signature; (ii) identification of the work; (iii) identification of the infringing material; (iv) contact info; (v) good‑faith statement; and (vi) statement under penalty of perjury of accuracy and authorization. We may remove content on receipt of a compliant notice and notify the uploader, who may submit a counter‑notice.

10) Third‑Party Services & Links
The Services may link to or integrate third‑party websites, tools, or services (e.g., Stripe/PayPal, Zoom, video hosts, CRM/marketing, learning platforms). We do not control and are not responsible for third‑party content or practices. Your use is governed by those third parties’ terms and privacy policies.
11) Data Protection, GDPR/UK‑GDPR/Swiss‑FADP & Global Privacy
We take privacy seriously. Our Privacy Notice and Cookie Notice explain how we process personal data. For EU/UK/Swiss users, the following apply:
11.1 Roles & Legal Bases
Controller. For most processing of personal data collected through the Site (accounts, purchases, marketing, support), the Company is a controller.
Processors. We use service providers (e.g., payment processors, hosting, email, analytics) as processors under data‑processing agreements.
Legal Bases. We rely on performance of a contract (to deliver orders, lessons), legitimate interests (security, fraud prevention, service improvement, limited marketing to existing customers), consent (certain marketing/cookies), and legal obligations (tax, accounting).
11.2 Data Subject Rights

We retain data for as long as needed to provide the Services, meet legal obligations, resolve disputes, and enforce agreements. We implement reasonable technical and organizational security measures appropriate to the risk.
11.5 Cookies & Tracking

11.6 Children’s Privacy
The Services are not directed to children under 16. We do not knowingly collect personal data from children without appropriate consent. If you believe a child has provided data, contact us to delete it.
12) Acceptable Use & Security
You agree not to: (i) interfere with the Site’s operation; (ii) probe, scan, or test vulnerabilities; (iii) circumvent access or security; (iv) use bots/scrapers without permission; (v) upload malware or illegal content; (vi) infringe IP, privacy, or publicity rights; (vii) harass or defame others. We may monitor, log, and block traffic for security and fraud prevention.
13) Health, Wellness & Educational Disclaimers
Music, voice, and instrument instruction are educational only. We do not provide medical, therapeutic, or legal advice. You are responsible for your own health decisions; consult qualified professionals as needed. Results vary with practice and individual factors.
14) Warranties Disclaimer
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant uninterrupted, secure, or error‑free operation.
15) Limitation of Liability
To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; and (b) our total liability for any claim arising out of or relating to the Services shall not exceed the greater of (i) the amount you paid to us for the specific product/service giving rise to the claim in the 3 months preceding the event, or (ii) USD $100. Some jurisdictions do not allow certain limitations; in such cases, the limitations apply to the maximum extent permitted.
16) Indemnification
You agree to defend, indemnify, and hold harmless the Company and its owners, affiliates, and service providers from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your: (i) use of the Services; (ii) violation of these Terms; (iii) violation of any law or third‑party right.
17) Force Majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control, including acts of God, pandemic/epidemic, labor disputes, governmental actions, war/terrorism, utility failures, supply chain disruptions, or internet/hosting outages. If performance is delayed for more than 30 days, either party may cancel affected orders without further liability, except for amounts already due for delivered portions.
18) Governing Law; Venue; Dispute Resolution
Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict‑of‑laws principles.
Venue. Exclusive venue for any permitted court action lies in the state or federal courts located in Humboldt County, California, and you consent to their jurisdiction.
Informal Resolution. Before filing a claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally within 30 days.
Arbitration (Optional Clause). Except for small‑claims matters and claims seeking injunctive relief for IP misuse, disputes may be resolved by binding arbitration under the rules of JAMS or AAA, seated in San Francisco, California, in English, with one arbitrator. If you reside in the EU/UK/Switzerland or another jurisdiction limiting consumer arbitration, this clause applies only to the extent permitted by your local law.
Class Action Waiver. To the extent permitted by law, disputes are conducted only on an individual basis and not in a class, consolidated, or representative proceeding.
19) Suspension & Termination
We may suspend or terminate your access at any time for any violation of these Terms, fraud, abuse, or risks to security or other users. Upon termination, all licenses terminate and you must cease use of the Services. Sections intended to survive (including 4, 7–9, 11, 14–20) survive termination.
20) Changes to Terms
We may update these Terms from time to time. The “Effective Date” will reflect the latest revision. Material changes will be posted to the Site or communicated via email/portal notice where feasible. Your continued use after changes constitutes acceptance.

22) Entire Agreement; Severability; Assignment
These Terms, together with the Policies and any order‑specific terms, constitute the entire agreement between you and us regarding the Services and supersede prior understandings. If any provision is held invalid, the remainder remains in effect. You may not assign your rights without our written consent; we may assign to an affiliate or successor.
23) Country‑Specific Terms (If Required by Local Law)
EU/EEA & UK Consumers. Nothing in these Terms limits mandatory consumer rights under local law. You may have a 14‑day withdrawal right for certain distance sales that has exceptions (e.g., digital content after access/activation, personalized services). Where applicable, instructions for exercising withdrawal will be provided.
California Users. You may request certain information about disclosures to third parties for direct marketing under California Civil Code §1798.83. We do not sell personal information as defined by the CCPA/CPRA; see our Privacy Notice for your rights.

We may include affiliate links and earn commissions on qualifying purchases. We only recommend products we believe provide value; however, your experience may vary. Prices and availability are subject to change by merchants.
25) Anti‑Fraud & Fair Use
We use automated and manual anti‑fraud checks. We may rate‑limit downloads, watermark digital files, or revoke access for suspected abuse. Multiple refund requests after extensive use, chargeback abuse, or content sharing may result in account closure.
